DEL WEBB SETTLES DISPUTE WITH COACHELLA VALLEY PARK DISTRICT
PHOENIX, March 20 /PRNewswire/ -- Del Webb Corp. (NYSE: WBB) announced today that a lawsuit previously filed by the Coachella Valley Recreation and Park District (CVRPD) against the Riverside County Board of Supervisors and Del Webb has been settled and dismissed.
CVRPD's lawsuit contended that the Supervisors had not awarded CVRPD sufficient fees under California's Quimby Act for Del Webb's Sun City Palm Springs project. The Quimby Act states that cities and counties may impose fees on developers to provide funds to establish park and recreational facilities to serve residents of the development.
Based on the substantial amount of park and recreational facilities that Del Webb already had planned for the project, the supervisors awarded CVRPD $250,000 in Quimby fees at the time of approving the project's overall specific plan. CVRPD's lawsuit contended that the supervisors erred in setting the amount at $250,000 and in determining it at the specific plan rather than at the tract map stage, and sought up to an additional $5 million in Quimby fees.
In the interest of resolving the dispute and avoiding future problems threatened by CVRPD, Del Webb agreed to pay CVRPD an additional $750,000 over the life of the project and the CVRPD has waived any claims it may have for additional Quimby fees as the project is built out.
Frank Pankratz, president of Del Webb California Corp. and general manager of Sun City Palm Springs, stated, "We were very disappointed that CVRPD sought to overturn the decision of the supervisors, but the matter has now been resolved and will not cause further delays in development of the project."
