DATAPOINT FINALIZES SETTLEMENT OF PATENT LITIGATION WITH NORTHERN TELECOM

 SAN ANTONIO, Texas, Dec. 11 /PRNewswire/ -- Datapoint Corp. (NYSE: DPT) today announced that the agreement in principle to settle the patent litigation brought against it by Northern Telecom Inc. has become final. Datapoint made the initial payment of $7,500,000 provided for under the agreement on Dec. 10, and a dismissal with prejudice of the Northern Telecom action against Datapoint was filed in federal court in Dallas the same day.
 Datapoint Chairman Asher B. Edelman stated, "We are pleased to have settled with Northern Telecom, eliminating the uncertainty this suit cast on Datapoint's future."
 The agreement in its final form provides for the $7,500,000 initial payment made Dec. 10, a 10-year interest-free secured note for $10 million payable in equal annual installments of $1 million each, and contingent payments based on Datapoint's profitability. The contingent payments may not exceed a maximum of $12,500,000, and are to be paid in annual installments to be calculated at 33 1/3 percent of Datapoint's pre-tax annual profits in excess of $10 million in each of Datapoint's next 10 fiscal years commencing with the current fiscal year.
