"NAFTA Chapter XI and Canada's Environmental Sovereignty: Investment Flows, Article 1110 and Alberta's Water Act" (2007) 65(2) U.T. Fac. L. Rev. 107

The authors of "NAFTA Chapter XI and Canada's Environmental Sovereignty: Investment Flows. Article 1110 and Alberta's Water Act" (2007) 65(2) U.T. Fac. L. Rev. 107 wish to clarify that footnote 157 should not have referred to the Sun Belt dispute, which did not lead to a settlement by the Government of Canada. In Sun Belt, there was a set dement of the expropriation issue, hut this settlement was by the Government of British Columbia, and involved, not Sun Belt Water Inc. but its joint venture partner, Snowcap Waters Ltd., a British Columbia corporation. Therefore, thc settlement did not involve the application of NAFTA Chapter XI. Any references in the article to a settlement in the Sun Belt dispute should he read in bight of the foregoing. While the clarification does not affect the reasoning or conclusions of the article, the authors apologize for any inconvenience that this error has caused.
