COURT SETS TRIAL DATE IN QUAL-MED - HEALTH NET MANDATE ACTION

COURT SETS TRIAL DATE IN QUAL-MED - HEALTH NET MANDATE ACTION
PUEBLO, Colo., Oct. 22 /PRNewswire/ -- Qual-Med Inc. (NASDAQ: QLMD) said today that, in its previously announced litigation in Sacramento, Calif., relating to, among other things, the February 1992 conversion of Health Net from a not-for-profit corporation to a for-profit corporation, the California Superior Court has ruled that Qual-Med's action seeking to overturn the Health Net conversion can proceed to trial as can Qual-Med's causes of action against Health Net for conspiracy and defamation.
Qual-Med's conversion-related claim seeks a writ of mandate which would command the Commissioner of Corporations of the State of California to revoke the sale of Health Net to Health Net Management Holdings Inc. (HNMH) and otherwise declare the Commissioner's approval of the conversion as unlawful.
The Superior Court dismissed Qual-Med's other claims against Health Net, HNMH, the California Wellness Foundation and certain other individuals.
The Superior Court also suggested that Qual-Med and the California Wellness Foundation enter into a stipulation that the Foundation not invade the principal it received in the conversion pending the outcome of the trial and these parties have agreed to do so.
On Tuesday, the presiding Judge of the Sacramento County Superior Court ordered a trial date of Feb. 16, 1993 for the mandate action and, for trial purposes, severed the mandate action from Qual-Med's other claims to permit the claims to be tried in separate actions.
Separately, in Qual-Med's Los Angeles action in Superior Court against the California Wellness Foundation, Health Net and HNMH relating to breach of contract claims arising out of Qual-Med's attempt to acquire Health Net earlier this year, the Court has stayed the action pending resolution of the Sacramento proceedings.
