COURT ORDER BARS COMDISCO FROM PASSING OFF
ANY MORE COUNTERFEIT IBM MEMORY CARDS
CHICAGO, Nov. 6 /PRNewswire/ -- An order barring Comdisco Inc. (NYSE: CD) from passing off any more counterfeit IBM (NYSE: IBM) 3090(A) memory cards as genuine IBM products was issued today in U.S. District Court in Chicago.
The order also directs Comdisco to disclose all instances in which it has marketed 3090 memory cards bearing the IBM trademark that were not, in fact, manufactured by IBM. Comdisco is also required to send a written notification to every customer who has received the counterfeit memory cards.
The contents of the order were agreed to by IBM and Comdisco.
"I am delighted that we were able to resolve this preliminary issue quickly and decisively," said William O. Grabe, IBM vice president and general manager, marketing and service, IBM United States.
IBM is continuing to press its claim for damages caused by Comdisco's unlawful conduct. IBM said it is also continuing its investigation of other parties who are believed to have provided counterfeit IBM memory cards to unsuspecting customers.
