COURT DISMISSES FARGNOLI LAWSUIT AGAINST ZIFFREN, BRITTENHAM & BRANCA; LAW FIRM CONTEMPLATING ACTION AGAINST PLAINTIFF

LOS ANGELES, April 19 /PRNewswire/ -- Ziffren, Brittenham & Branca said today that a suit filed against the law firm by former client Steve Fargnoli has been dismissed for lack of merit by the Superior Court of the State of California for the County of Los Angeles. The court granted the law firm's motion for summary judgment.
Because it believes the Fargnoli lawsuit was filed without probable cause, ZB&B said it is contemplating filing a motion for sanctions, or pursuing other legal relief, against Fargnoli, who was a client from 1983 to 1986, and his current law firm for filing a frivolous complaint. Under Section 128.5 of the California Code of Civil Procedure, "an action is deemed frivolous or in bad faith if it is prosecuted for improper motive or if it is totally and completely devoid of any merit."
"We are obviously pleased by the court's decision to throw out the case for lack of merit. As we have stated before, matters like this are best handled through the normal judicial process where decisions are made on the merits, instead of trying cases in the media by making false accusations," said partner Kenneth Ziffren. "We may now have to take the additional step of seeking sanctions or other relief against the plaintiff for such a blatant abuse of the legal process. The integrity of this firm is our most precious asset, and we must take forceful action to defend it against those who would attempt to damage our reputation with frivolous lawsuits."
