COURT DENIES QUAKER STATE ATTEMPT TO HALT CASTROL ADVERTISEMENT
NEW YORK, April 14 /PRNewswire/ -- A federal judge has denied Quaker State's request to stop publication of a Castrol print advertisement that Castrol GTX 20W-50 is the only leading motor oil in America to pass the world's toughest performance standards.
U.S. District Judge Charles S. Haight, Jr., found that Quaker State had failed to show the advertisement was either false or misleading to consumers.
As a result, Castrol may continue placing this advertisement in publications, according to Edward J. Carhart, Vice President of Marketing and Sales for the Automotive Division of Castrol.
The advertisement states that Castrol GTX 20W-50 motor oil was tested against every leading 5W-30, 10W-30 and 10W-40 oil and that only Castrol's 20W-50 oil met all of the performance standards of the Committee of Common Market Automobile Constructors (CCMC), the world's toughest standards.
Judge Haight stated is his ruling that the "text of the Castrol advertisement together with its headline ... results in a statement which is factually correct ... Quaker State does not challenge the factual accuracy of those statements."
