COURT DENIES CONNER PERIPHERALS' MOTION FOR PRELIMINARY INJUNCTION AGAINST WESTERN DIGITAL

IRVINE, Calif., Aug. 23 /PRNewswire/ -- Western Digital Corp. (NYSE: WDC) said today that the court had denied the motion of Conner Peripherals Inc. for a preliminary injunction in Conner's infringement suit against Western Digital. Conner had sought the preliminary injunction claiming that its patents covered Western Digital's one platter and two platter 170 megabyte and 340 megabyte 3.5-inch Caviar disk drives.
Conner argued that it was harmed because Western Digital had been able to beat Conner to the market for these drives by nine months to a year. Conner also argued that Western Digital's alleged use of three Conner patents (two of which were acquired from others) would continue to cause irreparable harm to Conner. The court denied Conner's motion on numerous grounds, including that Conner had failed to establish probable success on any of the claims.
A Western Digital spokesman said that the company had expected the judge's ruling and was particularly pleased that the court relied on several of Western Digital's arguments in rejecting Conner's motion.
The Conner suit, which alleges infringement by Western Digital of five patents in all, is pending in the United States District Court for the Northern District of California. A Western Digital patent suit against Conner is pending in the Central District.
