COPYRIGHT SUIT AGAINST AMERICAN BUSINESS INFORMATION, INC. DISMISSED

OMAHA, Neb., Nov. 8 /PRNewswire/ -- American Business Information, Inc. (NASDAQ: ABII) today announced that the United States District Court for the Northern District of Georgia granted American Business Information, Inc.'s (ABI) motion for summary judgment in ABI's suit with BellSouth Advertising & Publishing Corp. (BAPCO). BAPCO had sued ABI in 1990 alleging that ABI was infringing BAPCO copyrights by taking listing information (name, address, telephone number, type of business, franchise identification, etc.) from yellow page directories. BAPCO had previously dismissed its claims against ABI for damages. ABI had filed a motion for summary judgment, arguing that the information in question was not copyrightable. Ruling in ABI's favor, the court found that the information taken by ABI from the BAPCO directories was not copyrightable. The ruling is subject to appeal by BAPCO.
Vinod Gupta, chairman of ABI's board of directors, said that the court's ruling represents a major victory for ABI which has been litigating copyright infringement claims with Bell telephone company directory publishers for more than eight years. This order resolves the 1990 lawsuit in ABI's favor and establishes that ABI's longstanding business practices of collecting facts from published yellow pages directories complies fully with copyright law.
