COPYRIGHT INFRINGEMENT BATTLE WON AGAINST FRENCH FIRM, DACS
WEST PALM BEACH, Fla., Jan. 9 /PRNewswire/ -- Three former employees of the French affiliate of U.S.-based Philip Crosby Associates, Inc. have been found liable for copyright infringement and acts of unfair competition. The ruling affects Michel Debaig, Bruno Adrien, Jean Francois de Chorivit and their company, DACS, a competing quality-consulting company they began.
The appellate court in Lyons, France, affirmed a lower court's ruling that DACS produced and distributed manuals that imitated the copyrighted Crosby training manual and violated the Crosby copyright. As a result of the judgment, the defendants must immediately stop producing and using their infringing manual and are subject to fines if they use it again in the future.
The two courts also agreed with the Crosby lawsuit that DACS and the three defendants copied the format and techniques of the Crosby teaching style, diverted Crosby clients and prospective clients, and violated their non-competition pacts.
The defendants have been ordered to pay costs, and the appellate court will set the amount of damages they also are liable for. "The value of the materials, techniques and teaching styles that have distinguished Philip Crosby Associates, Inc. from the rest of the marketplace since the company's inception in 1979 is shown in the success stories of our many clients," said Larry McFadin, the company's chairman and chief executive officer. "The case reflects this company's determination to protect its rights in its valuable training materials and techniques. We will take vigorous action against infringement and unauthorized uses of our materials."
