CONRAIL WELCOMES PRICE NEGOTIATIONS WITH CP RAIL IN THE PHILADELPHIA RECIPROCAL SWITCHING CASE

 PHILADELPHIA, May 20 /PRNewswire/ -- Consolidated Rail Corporation (NYSE: CRR) (Conrail) announced today that it will negotiate with the CP Rail regarding the price for providing CP Rail reciprocal switching service to rail shippers on Conrail lines in the City of Philadelphia.
 At the same time, Conrail announced it is appealing a ruling by the Interstate Commerce Commission (ICC), reached on April 23 and released on May 12, that held, among other things, that CP Rail acquired reciprocal switching rights when it acquired the Delaware and Hudson Railroad (D&H) in 1991. Conrail will appeal on various grounds, including the fact that it was never given an opportunity to address the ICC on the issues involved in CP Rail's supposed 1991 acquisition of the switching rights.
 "The commercial issue is price," said Charles N. Marshall, Conrail's senior vice president-Development. "We have invested a substantial amount of money in our physical plant...track, trackbed, signals, and so forth. We installed it and it is our responsibility to keep it well- maintained. Many people don't realize that CP Rail already has access to all Philadelphia shippers at established prices called 'divisions'. CP Rail's ICC actions are aimed at a price reduction by Conrail so that CP Rail's share of the money will increase."
 Marshall continued, "Conrail must negotiate a price from CP Rail that covers all our costs. Only Conrail, not CP Rail, has invested in track in Philadelphia, and we will not subsidize CP to use it."
 Reciprocal switching is the hauling of one railroad's cars on another's tracks within a specified area for a fee.
 Conrail operates a rail freight network in 14 Northeastern and Midwestern states, the District of Columbia, and the Province of Quebec.
