CONMED ANNOUNCES PATENT DECISION

UTICA, N.Y., Oct. 14 /PRNewswire/ -- CONMED Corporation (NASDAQ: CNMD) today announced the results of a previously reported patent infringement lawsuit concerning certain specialty coated electrosurgical accessory blades sold by the company. In a U.S. District Court trial held in Salt Lake City, the jury found that CONMED's current line of coated electrosurgical blades willfully infringed a patent held by Megadyne and awarded damages of approximately $1,000,000. Additionally, the court could treble the damage award and order CONMED to pay Megadyne's attorney fees; a hearing on these matters is scheduled for Oct. 25, 1993. The court has also issued an injunction prohibiting CONMED from selling the affected products.
CONMED currently estimates the possible loss to be approximately $1,500,000 including inventory and certain capitalized items but before the possibility of the damage award being trebled and the court ordering CONMED to pay Megadyne's attorney's fees. In addition, the company incurred approximately $500,000 in legal fees associated with this litigation in the third quarter. Sales of the electrosurgery accessory blades in question account for less than 2 percent of CONMED's annualized sales.
Eugene R. Corasanti, chairman of the board and president of CONMED Corporation, said, "We are extremely disappointed by the jury's verdict and are exploring all of our options which include appeal. Additionally, we intend to petition the court to set aside the jury verdict."
CONMED, headquartered in Utica, N.Y., has manufacturing facilities in Denver and Haverhill, Mass. CONMED Corporation develops, manufactures and markets medical products for surgery and critical care use in hospitals and other health facilities in the United States and foreign markets.
