CMS ENERGY AFFILIATE WINS MAJOR FEDERAL COURT VICTORY

 DEARBORN, Mich., March 31 /PRNewswire/ -- The Midland Cogeneration Venture (MCV) Limited Partnership, of which a CMS Energy Corporation (NYSE: CMS) affiliate is a 49 percent partner, has won a major legal victory as the United States Court of Appeals for the District of Columbia Circuit rejected appeals by the Michigan Attorney General and the Michigan Municipal Cooperative Group (MMCG) to overturn the Qualifying Facility (QF) status of the MCV.
 The D.C. circuit court's order, issued only 10 days after oral argument, confirms the MCV's QF status as certified by the Federal Energy Regulatory Commission (FERC) under the 1978 Public Utility Regulatory Policies Act (PURPA).
 CMS Energy noted that this significant decision decisively rejects contentions by opponents of the MCV that it is not entitled to QF status under federal law. The 1.5 million electric customers served by CMS Energy's affiliate, Consumers Power Company, continue to benefit from the MCV's capacity, as indicated by electric sendout records established in January, February and March this year.
 The FERC originally certified the MCV as a QF under PURPA in 1987. On two subsequent occasions in 1990 and 1991 it recertified the facility as a Qualifying Facility. Before the D.C. circuit court were petitions by the MMCG and the Michigan Attorney General seeking to overturn the latest recertifications.
