CHEMICAL WASTE MANAGEMENT STATEMENT ON SUPREME COURT ISSUE

CHEMICAL WASTE MANAGEMENT STATEMENT ON SUPREME COURT ISSUE
OAK BROOK, Ill., Jan. 8 /PRNewswire/ -- Late yesterday the solicitor general filed a brief on behalf of the federal government urging the U.S. Supreme Court to grant Chemical Waste Management, Inc.'s (NYSE: CHW) petition for review of its challenge of the Alabama tax law directed at the company's Emelle, Ala., facility, Chemical Waste announced today.
The government's brief supports the company's position and that of the amici curiae that Alabama's $72 additional tax on out-of-state waste is unconstitutional. The government also urged the Supreme Court to vacate the Alabama Supreme Court's opinion on the $25.60 base fee and cap provision and to return them to the Alabama courts for consideration "under the proper legal standards."
The company is hopeful that this filing will allow for a decision by the Supreme Court during this term, which concludes in July.
