CATERPILLAR FILES SUIT AGAINST UAW

DECATUR, Ill., Dec. 23 /PRNewswire/ -- Caterpillar Inc. (NYSE: CAT) has filed suit against the United Auto Workers union, seeking to have the UAW's practice of requiring companies to pay the salaries and benefits of many of its full-time officials declared illegal under the Labor Management Relations Act (LMRA).
The suit was filed in U.S. District Court in Pennsylvania against the UAW's international union and its affiliate, Local 786, which represents employees at Caterpillar's York facility.
Caterpillar charges the UAW has traditionally put economic pressure on its

pattern'' companies to pay full wages and benefits plus overtime to the union's full-time committeemen even though the committeemen are on leave of absence from the company. The company says that practice violates Section 302(a) of the LMRA which says it's unlawful for an employer to pay any money to any officer or employee of a labor organization which represents its employees.
Caterpillar also says the UAW, in the only contract proposal it has made since bargaining began, proposed that committeemen be paid as much as 54 hours per week at top rates plus a night bonus for performing a minimum of eight hours of UAW-related work during the week.
Caterpillar ceased paying the committeemen on Nov. 16, 1992, giving them the options of returning to a full-time position in the shop or having the union pay their wages and benefits.
