CANDIE'S WINS INJUNCTION AGAINST L.A. GEAR

NEW YORK, Nov. 23 /PRNewswire/ -- Candie's Inc. (NASDAQ: CAND), owner of the CANDIE'S footwear trademark, said it has won a permanent injunction against L.A. Gear California, Inc. which prohibits their use of the Candie's TAKE A HIKE trademark. The Honorable Judge Charles S. Haight of the Federal Court Southern District New York ordered L.A. Gear to immediately cease and desist from the use of the mark. Further, the court permanently enjoined and restrained L.A. Gear from any future use in connection with the TAKE A HIKE mark.
In a judgment decreed by Judge Haight, Candie's asserted that L.A. Gear infringed upon Candie's rights as owner of the TAKE A HIKE trademark when L.A. Gear used the mark in their Fall '93 advertising. L.A. Gear was ordered to cease using any reference or likeness to TAKE A HIKE in its advertising or products and in the final court documents L.A. Gear assigned the mark to Candie's.
The TAKE A HIKE trademark has been the subject of a heated battle between Candie's and L.A. Gear. The Candie's TAKE A HIKE collection is the company's active outdoor footwear, and includes hiking, sport and work boots. The Company launched the line with a celebrated national print and television campaign which featured a woman wearing a pair of TAKE A HIKE boots seated on the lap of a seemingly nude man. The commercial was banned by several networks for its provocative nature which garnered national publicity including "Entertainment Tonight," "Fox Style News," as well as the cover of The New York Post and dozens of other stories. Candie's also used the mark in conjunction with a major national promotion involving over 1 million shoe boxes whereby consumers were offered a tee shirt featuring the TAKE A HIKE mark.
Neil Cole, president of Candie's, Inc., said, "We are pleased that the court has agreed to enforce our rights to the TAKE A HIKE mark. We believe strongly in the outdoor footwear category and the TAKE A HIKE mark captures both the spirit and playfulness of our collection."
