CALIFORNIA PLASTIC SURGEONS TAKE SECOND LOOK
AT FDA ACTION REGARDING SILICONE GEL BREAST IMPLANTS
LOS ANGELES, Feb. 5 /PRNewswire/ -- The California Society of Plastic Surgeons Inc. (CSPS) has announced it has come to a new conclusion about the moratorium placed on silicone gel breast implants by FDA Commissioner David Kessler, according to John O. Strong, M.D., CSPS president.
"In all the coverage by the national media of this story, it seems only a handful of news organizations have identified the real culprit -- the contingency fee trial lawyers who potentially can make billions of dollars from lawsuits by women who have had such implants," said Strong.
"In particular, the Wall Street Journal and Barron's have editorialized and reported that such lawyers have politicized the subject by taking what should be a scientific study out of the hands of scientists and doctors, and placing it in the courtroom, where it has no chance for true scientific examination and evaluation.
"Both publications, and an organization called the Washington Legal Foundation, have identified many individuals calling for the ban, as having serious conflicts of interest. These include members of the FDA's panel investigating the product who have received large fees as expert witnesses for the plaintiff in breast implant cases.
"In addition, serious questions have been raised about the legality of the FDA's action and about the alleged lobby for prohibition of the implants by a Ralph Nader organization, which is selling "how-to kits" to lawyers on suing implant manufacturers. These and other questions have raised serious doubts in the minds of many doctors about the true concern of those who would ban implants.
"Aside from all these concerns, the saddest one described by the Wall Street Journal is that with a ban, science may never again have a chance to prove or disprove the safety of the implants. The Journal points out that other products have been taken off the market by manufacturers, despite lack of evidence regarding their 'danger,' simply because defending the products was more costly than the revenue brought in by them.
"Despite this gloomy outlook, we urge Secretary of Heath and Human Services, Louis Sullivan, to convene a different, impartial review panel, thereby putting to rest the fears of some 2 million women who have received such implants, and who are now frightened by lawyer- induced media hysteria," Strong concluded.
The California Society of Plastic Surgeons is a medical society of board-certified plastic surgeons whose goals include continuing education for members, providing public information for public safety, and interaction with legislative and education bodies on maintaining the highest quality medical standards and on matters affecting plastic surgery. More than 400 plastic surgeons are now members of the society which was founded in 1950.
