CALGENE CLARIFIES MISLEADING PRESS REPORTS ON ENZO LITIGATION

 DAVIS, Calif., June 25 /PRNewswire/ -- Calgene, Inc. (NASDAQ: CGNE) today clarified misleading press reports about a procedural ruling made by a U.S. District Court last Friday in the ongoing antisense patent disputes between Enzo Biochem and Calgene.
 "The Federal courts in California and Delaware are simply deciding the location for determining whether or not Enzo's patent is valid," stated Rod Stacey, Calgene's president and COO. "This is merely a procedural issue and has nothing to do with the merits of the case. In whatever court this case is litigated, we believe the Enzo patent will be held invalid."
 On Friday, June 18, Judge Garcia, U.S. District Court, E.D., California, held that Calgene's complaint that Enzo interfered with Calgene's January, 1993, stock offering would be heard in California. The judge also held that the lawsuit filed by Enzo in Delaware on the morning that the Enzo patent issued was the first lawsuit filed on the patent, indicating that the patent validity suit will be heard in Delaware.
 "In the whole scheme of things, it is of little significance to Calgene where the lawsuit on the patent issues moves forward," noted Stacey. "Clearly, Calgene prefers to have all of its disputes against Enzo resolved in the same forum."
