Brothers lynching case - LHC dismisses bail applications of nine accused.

By LAHORE, August 25, 2011 (Balochistan Times): A division bench of the Lahore High court on Wednesday dismissed as being withdrawn the bail applications of nine accused involved in Sialkot brothers lynching case. The bench comprising Justice Rauf Ahmad Sheikh and Justice Mazahar Ali Akbar Naqvi was hearing the bail applications of Hassan Raza, Muhammad Asghar, Akram, Jamshed, Iqbal, Sarfraz, Owais, Rashid Ali and Asghar Ali. The petitioners submitted in their bail application that an FIR was registered at Sialkot Sadar Police Station against them with other co-accused on August 8, 2010 wherein it was alleged that they after forming an unlawful assembly had murdered two young boys namely Mughees Sajjad and Muneeb Sajjad in a cruel manner. The petitioners said that they were arrested in August 2010 and have been behind the bar ever since. The petitioners contended that the four other co-accused involved in the case had been granted bail and a rule of consistency be applied in their matter as well. They contended that they were innocent and falsely involved in the case, therefore, their bail applications be accepted. However, the prosecution opposed the request contending that the Supreme Court had already given direction to decide the case against the accused quickly, therefore, at this stage their bails would effect the trial, if granted. At this stage, the petitioners counsel requested the court to allow him to withdraw the bail applications. The bench after hearing arguments of both parties dismissed as being withdrawn the bail applications of the accused.
