Brothers face court on sex attack claim.

Byline: Court reporter

TWO brothers have gone on trial in Cardiff accused of sexually assaulting a small boy 40 years ago. Prosecutors say the alleged victim, now a man of 50, only found the strength to go to South Wales Police with his complaint in September 2010.

But he had told his GP more than a decade ago.

The man, who cannot be named for legal reasons, told a jury yesterday that he had not gone into any detail with the doctor.

"I just told her I had been molested as a child," he told Cardiff Crown Court yesterday via a video link.

Listening and watching from the dock were brothers Brian Perry, 61, and Dennis Perry, 64, of Heol yr Odyn, Ely, who both deny charges of a serious sexual assault.

When they were arrested, each remembered the boy but said his claims of being seriously sexually assaulted were simply untrue.

He claimed he was taken into bushes and attacked by Brian Perry while looking for conkers.

Dennis Perry, he said, followed him into public toilets on a summer's day out in Victoria Park. "He was behind me when I went in and closed the cubicle door", the witness told the court.

Asked why he had not called out, he replied: "Fear."

It was suggested by defence barrister David Webster that none of what he was describing had ever happened.

The man told jurors: "Every word I have told you is the truth."

The court heard that in video interviews carried out at Cardiff Bay police station, Brian Perry, told of the man's allegations, said: "I don't know why he's doing it."

Divorced Dennis Perry, who has hearing problems, told officers: "It's not true - nothing happened."

He said that, as far as he knew, the man making the allegations had no grudge against him.

There had been no falling out between them and in fact he had not seen him for many years, he said.

Each brother was accompanied during the interviews by an "appropriate adult" who was there to ensure they understood the questions.

Prosecutor Tim Evans said: "The victim was just 10 years old at the time. They would have been between 20 and 25."

He told the jury: "You have to decide: is the witness telling the truth about these two brothers or did no indecency ever take place?" (proceeding)
