A Russellville company said it thought it was being an Arkansas Tech University financial supporter when it bought an ad in a school football program from University Sports Publications Co. of New York.
But Controlled Environmental Solutions Inc. alleges that none of the ad money made it back to the school, according to CES attorney Joe Williams of Indianapolis.
Controlled Environmental Solutions is suing University Sports for at least $10 million in damages. It also is seeking class certification for its claim of violating the Arkansas School Calendar Disclosure Act.
An attorney for University Sports said it paid Arkansas Tech for the work in collecting the ads.
"This lawsuit has already been thrown out of federal court," said Chris Clark of New York. "And they've now brought it in state court in an effort to extort money out of USP."
He said that he has the letter from Arkansas Tech authorizing USP to sell ads.
USP publishes game-day football programs and yearbooks for a number of colleges across the country.
Clark said the company helps colleges get ads for the programs "and we pay them for the rights."
CES said it bought advertising space in the 2005 and 2006 Arkansas Tech football programs and spent $850 each year.
The letter CES received from USP, which looked to be on ATU letterhead, said, "While providing a worthwhile service by supporting Arkansas Tech University, you are also gaining valuable exposure for your company."
CES said USP didn't disclose that most of the advertising money wasn't going to ATU, said the lawsuit, which was filed in Pope County Circuit Court.
An ATU spokeswoman couldn't determine by late Thursday afternoon how much USP had paid the school in 2005 and 2006.
