The Bishkek interdistrict court has canceled the decisions of the Bishkek and Central Election Commission on termination of Bishkek local council member's mandate of Jusupbek Korgonbai uulu ahead of term.
The latter filed a claim to the court seeking to invalidate the decisions of the Bishkek and Central Election Commissions saying they are unlawful.
The Central Election Commission terminated the mandate of Jusupbek Korgonbai uulu earlier over presence of Russian citizenship.
The Bishkek interdistrict court found that when making decision, the Central Election Commission used a copy of illegitimate letter of the Russian Justice Ministry. "The letter is not stamped and lacks apostille as admitted by the Central Election Commission itself. The arguments of the Central Election Commission that the information of the Russian Justice Ministry undersigned by the vice chairman of the department does not need to be certified with a stamp are not justified," the court ruling reads.
On December 24, 2018, the Central Election Commission received a complaint from a representative of Jusupbek Korgonbai uulu asking to invalidate the decision of the Bishkek local election commission on termination of a mandate ahead of term of December 19.
The working group for consideration of complaints referred to the State National Security Committee when saying that Jusupbek Korgonbai uulu used a Russian passport 4 times when crossing the borders.
Central Election Commission Chair Nurzhan Shaildabekova said Jusupbek Korgonbai uulu obtained a Russian passport in 2007. "On November 26, 2017, he submitted all necessary documents to renounce Russian citizenship. In July 2018, as a Russian citizen he submitted notification to migration authorities of Moscow that he has another citizenship, that is citizenship of Kyrgyzstan," she said.
The working group recommended the Central Election Commission to terminate the mandate given that dual nationality is not allowed by the national legislation.
