Beer containers nixed from backhauling bill

The House Energy and Commerce Committee has unanimously agreed to exempt beverage containers from legislation to prohibit the transport of solid waste in refrigerate trucks and railcars that are also used to carry food.

The bill will now go to the full House, which is expected to act on it within the next few weeks, according to a spokesman for the National Beer Wholesalers Association.

Initiative for the beverage container exemption amendment came from NBWA and the Coors Brewing Co., which ships all of its products in refrigerated vehicles. The legislation represents a compromise between the two House Committees that have considered bill on the issue. An earlier successful effort to exempt "food packaging" from one of those bills was supported by a coalition of beer and soft drink groups.

NBWA president Ronald Sarasin said he was confident that the Senate Commerce Committee, which is considering a companion bill, will agree to a similar exclusion of beverage containers.

"There was never any evidence that carrying empty containers in trucks used to deliver beer or soft drinks constituted a public health problem," Sarasin said. "But without this amendment, the bill could have shifted tremendous costs to wholesalers, especially in states with mandatory deposit laws."
