BREAST IMPLANT PROPOSAL BY DOW-CORNING FOR PARTIES TO SET UP $4.75 BILLION FUND

 ATLANTA, Sept. 9 /PRNewswire/ -- The following was released today by Guerry Thornton Jr., a partner with Thornton & Leff, in Atlanta.
 Thornton handles claims involving women's health care law. He handles claims against the $2.4 billion Dalkon Shield Claimants' Trust and represents 15 implant victims.
 At the present time, Dow-Corning and other parties are proposing that all litigants agree to the organization of a $4.75 billion plan that would be funded and pay recoveries on present and future claims over a 30-year period.
 Based on initial reports, the plan, if approved, would set up payment guidelines and the most serious claims may opt out of the plan to pursue claims through private litigation. The plan may require a threshold participation rate.
 "Implant victims must be cautioned to review this plan in great detail before they support it," said Guerry R. Thornton Jr., who represents victims, "and an estimation of the value of cases must be done to determine the fairness of the fund similar to proceedings in the A.H. Robins case." Thornton would support the concept of a global resolution if victims are given equality of treatment and fair awards.
 "This type plan can offer a means of resolving claims through a plan that is faster, more equitable and less costly than the private tort system," said Thornton, who actively supported the $2.4 billion Dalkon Shield plan.
 "To guarantee plan's success, victims must be notified of the plan's terms and act right away to protect their right to fair and equal treatment," said Thornton.
