BOXFORD MAN GUILTY OF MAIL FRAUD ANDCONSPIRACY TO DEFAULT THE INTERNAL REVENUE SERVICE

BOSTON, March 29 /PRNewswire/ -- The former president of a Massachusetts defense contractor pleaded guilty today to charges of mail fraud and conspiracy to defraud the United States by impeding the lawful functions of the Internal Revenue Service.
U.S. Attorney A. John Pappalardo announced that Antonio Moda, 63 Washington Street, Boxford, Mass., pleaded guilty today in a hearing before Senior United States District Judge W. Brevard Hand, a visiting judge from the Southern District of Alabama. A federal prosecutor informed Judge Hand that Moda was the president of Locke Manufacturing Company, a defense contractor located in Woburn, Mass., and a trustee of Locke Realty Trust, which owned the building in which Locke Manufacturing Company operated. On Jan. 31, 1987, Locke Manufacturing Company's roof collapsed as a result of an accumulation of snow. Repairs were made to the property, and claims were submitted to Sentry Insurance Company. The prosecutor stated that Moda caused false and inflated invoices to be submitted in support of one such claim in April, 1987. Sentry Insurance Company suffered a loss of approximately $65,000 as a result of the fraudulent claim.
In approximately the same time period, Moda was constructing a luxurious house in Boxford. The prosecutor stated that Moda conspired with others to defraud the Internal Revenue Service by causing both Locke Manufacturing Company and Locke Realty Trust to pay substantial portions of the cost of constructing the house, and making it appear that the payments by these entities were ordinary business expenses.
Judge Hand scheduled sentencing for June 30, 1993. Moda faces up to 10 years imprisonment and a fine of up to $500,000. Additionally, he faces liability for taxes, penalties and interest.
The case was jointly investigated by the Defense Criminal Investigative Service of the Department of Defense, the Federal Bureau of Investigation, the Internal Revenue Service's Criminal Investigation Division and the Naval Investigative Service of the United States Navy. It is being prosecuted by Assistant United States Attorney Mark W. Pearlstein of Pappalardo's Economic Crimes Unit.
