BIOPLASTY SETTLES PATENT INFRINGEMENT SUIT ST. PAUL, Minn., Oct. 6 /PRNewswire/ -- Bioplasty, Inc.
(NASDAQ-NMS: BIOP) announced today that it has settled the lawsuit brought by Mentor Corporation (NASDAQ-NMS: MNTR) alleging infringement on two of its patents relating to mammary implants.
Pursuant to the terms of the settlement agreement, Bioplasty, Inc. and Mentor Corporation have agreed to cross-license Bioplasty's United States Patent No. 4,955,909 (textured silicone shell) and Mentor's United States Patent No. 4,960,425 (textured silicone shell). Also, Mentor Corporation and Bioplasty, Inc. agree to cause their respective counsel to execute and file the Stipulation of Dismissal without Prejudice for the alleged infringement of Mentor's United States Patent No. 4,731,081. It is understood by both companies that they do not admit any liability on the claims asserted in the lawsuit. Bioplasty, Inc. has more than 20 years of experience in the development, manufacturing and marketing of plastic surgery products worldwide.
