BARR FILES APPEALS AZT CASE

POMONA, N.Y., July 29 /PRNewswire/ -- Barr Laboratories, Inc. (AMEX: BRL) announced today it has appealed the decision upholding Burroughs Wellcome's patent on AZT as a treatment for AIDS. The appeal follows a federal district court order last week that denied Barr's claim that scientists at the National Institutes of Health were co- inventors of AZT as an AIDS therapy. The court order cut short a trial that had begun some four weeks earlier.
"We are confident that once the appellate court clearly defines the issue of `conception,' as the term is used in the patent law, a new trial will establish the inventorship rights of the NIH scientists and Barr will be able to bring a less expensive generic AZT to market."
The appeal process is expected to take approximately one year.
