 AVIS ANNOUNCES FAVORABLE CONCLUSION TO SUIT FILED BY ITS ARCH-RIVAL
 GARDEN CITY, N.Y., Jan. 17 /PRNewswire/ -- Avis today announced the settlement of the lawsuit Hertz began when it failed to win the 1990 Alfred Award sponsored by Corporate Travel Magazine. "The settlement puts an end to one more effort of Hertz, acknowledged as the biggest car rental company in the U.S., to bully its competitors -- simply because of its size," said Russell James, vice president of corporate communications for Avis, Inc.
 "This is a classic example of Hertz employing the Goliath versus David approach. In essence, the judge told Goliath to go home and rent cars -- and to compete in the marketplace, not the courts," James said. "The lawsuit was brought when Avis failed to knuckle under to Hertz demands that they (Hertz) could decide when Avis should stop running a print ad that was shortly due to stop appearing. The print ad was run for a brief period, in a small number of travel trade publications. Under the settlement, in which U.S. District Court Judge William Connor provided able assistance, Avis agreed not to resume the ad, which had stopped running months ago -- in other words, to continue to not do what the company hadn't been doing. As part of the settlement, Hertz must adhere to guidelines regarding the use of their survey results throughout their advertising."
 The judge suggested the parties settle their dispute after hearing two days of testimony. Hertz had put most of its case on at that point, and Avis was prepared to demonstrate through expert witnesses that the Hertz survey, on which they based their advertising claims, was distorted. For example, of the several markets Hertz picks, it identifies one as the "Chicago market" but curiously omits the entire City of Chicago. The biased effect is that Hertz has redlined an entire metropolitan city.
