QI work for a large water company, on-call one in three weeks, for a week at a time.

For this I get paid PS115 per week and am on-call 16 hours per day Monday to Friday and 20 hours Saturday and Sunday, which works out at 95p per hour.

When on-call we have to respond within one hour, so we can't go for meals out or have a drink.

When we arrive on site we get the right amount per hour. Is this legal to be paid so little? Richard ALYS SAYS: Under the Working Time Regulations there are restrictions on how many hours you can be required to work and the rest breaks which you should receive.

Unfortunately, if you are entitled to spend the time on-call at home, this will not count as working time for the purpose of calculating your hours under the Working Time Regulation or in terms of the national minimum wage.

This means the amount you are paid for being available on-call, but at home, is something that is determined by your contract. As you say, your employer gives you 'the right amount of pay' when you are called out to site.

Providing this covers the national minimum wage for the hours you are working on site, this sounds legal, albeit unfair.

If you don't think you are getting the correct rest breaks or being paid the national minimum wage you should raise a grievance with your employer.

And, if you are a member of a union, speak to your rep.
