ARMSTRONG WORLD INDUSTRIES, GRATIFIED BY APPEALS COURT DECISION
LANCASTER, Pa., Oct. 28 /PRNewswire/ -- Armstrong World Industries, Inc., (NYSE: ACK) says it is gratified that an appeals court today sustained a U.S. District Court decision that a jury verdict against Armstrong cannot be allowed to stand and that the company is entitled to a new trial.
Earlier, Judge John W. Bissell of the U.S. District Court in Newark had overturned a jury verdict against Armstrong, in a ruling "notwithstanding the verdict." Now a three-judge panel of the U.S. Circuit Court of Appeals in Philadelphia has partially overturned his decision. However, in addition to supporting Judge Bissell's conclusion that the jury verdict against Armstrong was the result of improper conduct by the plaintiffs' attorney and therefore was not justified, the appeals court decision today narrows the scope of the case in the event it is retried.
The effect of the appeals court decision -- that Armstrong is entitled to a new trial -- is to set aside the outcome of the first trial, which ended in April 1991.
At this early stage, an Armstrong spokesman said, no date has been set for a new trial.
