APPELLATE COURT UPHOLDS U.S. SURGICAL CORPORATION'S INJUNCTION AGAINST ORIGIN MEDSYSTEMS, A SUBSIDIARY OF ELI LILLY

NORWALK, Conn., March 19 /PRNewswire/ -- Leon C. Hirsch, chairman of United States Surgical Corporation (NYSE: USS), announced today, "that the Court of Appeals for the Federal Circuit, Washington, D.C., has denied the Origin Medsystems, Inc., a division of Eli Lilly, request for a stay of USSC's preliminary injunction against Origin and its retracting tip trocar."
In denying the request, the court stated that "Origin (has) not persuaded us that they have a strong case on this issue or even a substantial case." The court denied the stay in view of "Origin's weak case on the merits..."
Mr. Hirsch stated, "We are gratified that the District Court and now the Court of Appeals have found in our favor. This should send a clear message to our competitors to respect our patents."
United States Surgical Corporation is the world's largest manufacturer and marketer of surgical staplers, the leader in the growing field of minimally invasive surgery and a recent entrant into the suture market.
