 AMANA DISTRIBUTOR FILES BOND IN 'COLD WAR' WITH AMANA
 NEWARK, N.J., Feb. 28 /PRNewswire/ -- Cooper Distributing Co., Inc.,


of Newark announced that it today filed a restraining bond of $350,000 in federal court as the next step in its battle with Amana Refrigeration, Inc., to retain its 30-year distributorship with the Iowa appliance manufacturer.
 Amana, a unit of the electronics and defense industry giant Raytheon Company (NYSE: RTN), attempted to cancel that relationship in November with ten days' notice. Termed a "cold war" by the Wall Street Journal, Cooper has since been operating its profitable Amana distributorship under the protection of a court restraining order.
 Cooper, which is Amana's largest distributor, was first granted a temporary restraining order on Nov. 13 in state court. Amana removed the case to federal court and in January, U.S. District Court Judge Maryanne Trump Barry awarded a preliminary injunction. Cooper is suing Amana under the New Jersey Franchise Practices Act which protects New Jersey businesses from being cancelled for any reason other than poor performance. Amana is challenging the legal definition of Cooper as a franchisee of Amana.
 Federal court requires that a bond be posted in cases where an injunction is awarded. Amana had originally requested that the bond be set at $2 million and subsequently asked for $1 million. The $350,000 bond amount, as set by Judge Barry, is intended to provide security for Amana in the event that Cooper loses the case and has to pay damages to Amana.
 Cooper Distributing had total sales last year of $23.5 million. Amana represents approximately 85 percent of Cooper's business. In 1991, Raytheon's total appliance business reached $998 million in sales out of $9.27 billion in total revenues for the company.
