ALLEN GROUP CORRECTS EARLIER NEWS RELEASE OF PATENT SUIT JUDGMENT
MELVILLE, N.Y., Jan. 21 /PRNewswire/ -- A Federal District Court in Chicago has entered a final judgment in favor of The Antenna Specialists Co. division of The Allen Group Inc. (NYSE: ALN) against Hamg Shing Industry Co. Ltd., a Taiwan company, for infringement of Antenna Specialists' patent covering its unique glass-mounted cellular ON-GLASS(R) mobile communications antenna design. The judgment includes royalty damages of $4.25 per antenna plus interest, a trebling of the damages for willful infringement of Antenna Specialists' patent and attorney fees and costs.
In a previous phase of the lawsuit, the court found that Hamg Shing had manufactured and sold infringing antennas and permanently enjoined Hamg Shing, and those participating with Hamg Shing, from making, using or selling infringing glass-mountable antennas in the United States. Although Hamg Shing denied infringement and claimed that Antenna Specialists' patent was invalid and unenforceable, the court entered a verdict in favor of Antenna Specialists after a jury found the patent valid and willfully infringed by Hamg Shing.
An earlier news release from Antenna Specialists indicated that the company had been awarded a judgment in the amount of $4,011,619. Various news services carried this portion of the news release with some erroneous facts or assumptions as to the collectibility of the judgment.
In light of the facts that the defendant is a Taiwan corporation which has represented that it is unable and/or unwilling to satisfy the judgment and has no assets in the United States and that Allen has determined that the cost and difficulty of seeking to enforce the judgment against the defendant in Taiwan is significantly greater than any benefit which it is likely to derive from such efforts, the parties have negotiated a confidential compromise settlement of the judgment that will not have a material impact on the financial results of Antenna Specialists or The Allen Group Inc.
The Allen Group Inc. manufactures and markets electronic and other products, principally for the telecommunications and automotive industries, including mobile communications equipment, automotive test equipment and truck components.
