ACUSON CORPORATION FILES PATENT INFRINGEMENT LAWSUIT AGAINST HEWLETT-PACKARD

MOUNTAIN VIEW, Calif. March 10 /PRNewswire/ -- Acuson Corp. (NYSE: ACN) today announced that it filed a patent infringement action on Thursday, March 4, 1993 against Hewlett-Packard Co. (NYSE: HWP) in Federal District Court in San Francisco.
In the suit, Acuson alleges that Hewlett-Packard infringes an ultrasound patent owned by Acuson. On March 8, Acuson added a claim to the suit that alleges HP infringement of a separate ultrasound patent licensed exclusively to Acuson. In the litigation, Acuson seeks an injunction and unspecified damages.
Following Acuson's March 4 lawsuit, Hewlett-Packard filed a separate action on March 8 against Acuson in Federal District Court in San Francisco, alleging patent infringement by Acuson. The patent involved in HP's suit was invented by Dr. Samuel H. Maslak, Acuson's president and chief executive officer, and was assigned to HP in 1979. Dr. Maslak was employed by HP before founding Acuson. In its litigation, HP seeks an injunction and unspecified damages.
"HP clearly infringes the two patents named in our lawsuit," said Charles H. Dearborn, Acuson general counsel. "HP has been disputing the ownership of one of the patents. Last week the U.S. Patent Office determined that the patent belongs to Acuson and that the claims Acuson is pursuing are valid," said Dearborn.
Commenting on HP's allegation, Dearborn said, "We believe we do not infringe the HP patent named in their suit and the patent is not enforceable against Acuson."
Acuson, based in Mountain View, is a leading designer, manufacturer and worldwide marketer of high performance medical diagnostic ultrasound systems. The company had sales of $343 million in 1992.
