A FIRST IN DADE COUNTY: FEDERAL JUDGE TESTIFIES

 MIAMI, Feb. 23 /PRNewswire/ -- In a highly unusual turn of events, a noted Federal Judge took the stand to testify in Dade County Circuit Court. U.S. District Court Judge William Hoeveler -- best known for presiding over the case of former Panamanian leader, Manual Noriega -- took the stand on Friday, Feb. 12, 1993 to testify on behalf of Dynaserv, a Miami-based consulting firm which filed a $1.1 million claim against Sunrise Club developer, Philip Scutieri for allegedly procuring the settlement of Scutieri's 11-year litigation with the now-defunct Southeast Bank. The jury on Wednesday, Feb. 17, ruled in favor of Scutieri and also awarded him $78,000 in legal fees.
 David A. Freedman of the Miami firm of Shapo, Freedman & Fletcher, P.A., represented Scutieri and said that it was virtually unheard of to have a federal judge testify about a litigant who had previously been before his court. Judge Hoeveler had presided over Scutieri's prior litigation against Southeast Bank.
 Also appearing as witnesses were the former Chief Counsel to the United States Senate Banking Committee and Chief Counsel to the Federal Deposit Insurance Corporation (FDIC).
 When asked how one cross-examines a federal judge, Freedman stated, "It called for tactful aggression."
 The verdict brought to an end 13 years of bitter litigation for Scutieri and his Sunrise Club project, adjacent to Baptist Hospital.
 Added Freedman, "It was a case with an unusual twist during trial, but the outcome was quite satisfactory."
