159mph cop wins legal bid.

Byline: By ROD CHAYTOR

POLICEMAN yesterday won his High Court bid to overturn his conviction for dangerous driving at 159mph on the M54 in an unmarked patrol car.

PC Mark Milton, 40, an advanced police driver, was originally acquitted of the charge but was then convicted on appeal.

District Judge Peter Wallis found him guilty after ruling his driving skills were "irrelevant" to the case.

But yesterday two High Court judges said the district judge "misdirected himself" and told him to look at the case again.

Lady Justice Smith and Mr Justice Gross said he had to decide whether "PC Milton's unusual driving skills were such as to make a crucial difference to the dangerousness of his driving".

Lady Justice Smith said: "It seems to me that this matter is of considerable importance to both sides of the dispute."

PC Milton of Telford, Shrops, got an absolute discharge at Ludlow magistrates in August.
