SPORICIDIN AND FTC STAFF REACH PROPOSED AGREEMENT
ROCKVILLE, Md., May 29 /PRNewswire/ -- Sporicidin International has reached a proposed agreement with the staff of the Federal Trade Commission (FTC) that would resolve litigation brought against Sporicidin by the FTC in December 1991. Sporicidin earlier this month settled a related case brought by the Food and Drug Administration.
"We signed the consent decrees to avoid prolonged litigation which could last many years," said Dr. Robert I. Schattner, president of Sporicidin. "At this point, we have spent over $2 million in legal fees and expenses associated with the government actions. It is very difficult, both economically and emotionally, for a small company to sustain prolonged government action."
As part of the FDA settlement, the FDA issued market clearances for Sporicidin Disinfectant Towelettes, Sporicidin Disinfectant Sprays, and Sporicidin Disinfectant Solution. The company agreed to make certain label changes; no formula changes were required. The company has applied to FDA for clearances for its major product, Sporicidin Cold Sterilizing Solution, in undiluted form and in a high-strength dilution. The company has no plans to seek FDA clearance for Sporicidin Cold Sterilizing Solution in 1:16 dilution, which was the formulation primarily involved in the FTC case.
Sporicidin products were recalled on Dec. 13, 1991, as the FDA, FTC, and the Environmental Protection Agency (EPA) made Sporicidin a test case in a multi-jurisdictional attempt to imposed standardized regulation on all disinfectants used in the hospital/medical market. Sporicidin products have been registered under EPA's pesticide regulations since 1972 and had about 25 percent of the market before the recall took effect.
"We are pleased with the FTC and FDA agreements," said Dr. Curtis L. Lynch, vice president/medical director of Sporicidin. "They represent a giant step toward allowing the company to resume its business under clearer regulatory guidelines that we expect will be applicable to the entire industry, and not simply to Sporicidin."
The agreement with the FTC staff will become final after it is approved by the five FTC commissioners and by the federal district court in Baltimore.
