dataBahn Sues Unasat for Breach of Contract and Tortious Interference.

DALLAS -- dataBahn Inc., a pioneering leader in next-generation commercial satellite broadband solutions has filed suit against Unasat Communications citing Breach of Contract, Breach of Warranty under the Uniform Commercial Code, Tortious Interference with Prospective Advantage, Breach of Good Faith and Fair Dealing and other declaratory relief.

dataBahn executed a wholesale bandwidth agreement with Unasat Communications in early 2005 to provide space segment and network services supporting the introduction of their DOCSIS based Surfbeam modem to the commercial satellite market. The suit, filed May 24th, 2006 in Federal Court, cites eleven aggregated complaints against Unasat Communications LLC, including failure to deliver adequate bandwidth services as contracted, interfering with and disrupting customers' broadband services to confuse and frustrate dataBahn customers and enticement of dataBahn dealers to align directly with Unasat in order to compete against dataBahn. Damages, estimated in the millions of dollars, continue to accrue.
