Women's Caucus for Gender Justice closes with significant gains for the women's global movement.

It has been a busy and eventful five years since the Women's Caucus for Gender Justice was formed in 1997 to advocate for a gender perspective in the negotiations toward the International Criminal Court. Through the advocacy of many women, the Rome Statute stands as the most significant example of gender mainstreaming in an international treaty. The evidence of this is by now obvious to many--the explicit inclusion of rape and other crimes of sexual and gender violence as war crimes and crimes against humanity, an array of measures intended to ensure more empowered participation by and appropriate protection of victims and witnesses as well as provisions to help ensure a presence of women on the Court and gender experts among staff.

The advocacy continued after the Rome Statute into the negotiation of supplemental texts from early 1999 through mid-2002 where definitions of crimes were debated as well as rules of procedure and evidence. The Women's Caucus was present at this phase too, advocating for progressive and nondiscriminatory definitions of rape and other crimes of sexual and gender violence as well as appropriate rules of evidence for the trial of crimes of sexual violence.

Last year saw several key events that signalled the end of one phase of the establishment of the world's first permanent criminal court and the beginning of a new and exciting era. With the 60th ratification on April 11, 2002, the Rome Statute entered into force on July 1, 2002, marking the moment at which the Court's jurisdiction officially took effect. In September, the nomination period for judges was opened and then closed in November with 45 candidates, 10 of whom were women.

This year has proved to be no less eventful. The election of the Court's first 18 judges was held in February during which seven women were elected. Though the Women's Caucus had advocated all along for parity, the election of seven women was a historic achievement in light of the traditionally low number of women serving in international tribunals. The nomination and election of the judges was also significant for the way that NGOs at the national and international level worked together in an effort to help ensure the nomination and election of the most qualified candidates and a diverse court. Women's groups in particular worked to ensure their governments followed the appropriate procedures for the nomination of candidates, advocated for the nomination of qualified female candidates and spoke out if their governments failed to measure up to the standards set by the Rome Statute. Some took great risks in doing so. It was inspiring and exciting to see so many come together again in Different ways to have such an important and historic impact.

On March 11, 2003, the inaugural session of the Court was held in the Hague, the Netherlands at which time the judges were sworn into office. The Assembly of States Parties selected the Chief Prosecutor, Luis Moreno Ocampo of Argentina.

Now that the Court is officially opened, it is time to bring the advocacy of the Women's Caucus, as an effort, which arose to specifically address negotiations, to a close. It has been a long and multi-layered effort to this point with the involvement of many women from all over the world. The achievements and the Court now belong to everyone. Advocacy around the world's first permanent criminal court is unprecedented and so is the NGO advocacy needed.

Women's groups around the world must now own the ICC and incorporate this new mechanism of international justice and accountability more fully into the consciousness of out work and strategies. While the Women's Caucus, as a negotiation-focused initiative, has fulfilled its purpose and is being brought to a close, the effort to bring the critical gender and political perspectives to the work of the Court and help ensure the gender gains continue to be implemented will continue in different ways. One of these ways will be through an effort known as Women's Initiatives for Gender Justice which will have a staff person in the Hague but which will emphasise the development of regional capacities.

We will be closing the Women's Caucus' New York office soon to mark the completion of this historic initiative and will be in touch as plans continue to develop toward the future. We offer out thanks and congratulations to all those who contributed in any way to this effort--through participation in preparatory commission meetings, advocacy in capitals, responding to action alerts, participating in workshops and trainings and subsequent awareness-raising, through offering insights and expertise in documents, proposals and recommendations, not to mention the invaluable assistance of staff, volunteers, interns, and translators.

Apres Avoir d'importants succes en faveur du mouvement feminin mondial, le Caucus de femmes pour la Justice de Genre se CLOTURE 

Les cinq dernieres annees ont ete chargees et pleines d'evenements pour le caucus des femmes pour la justice de genre cree en 1997 pour militer en faveur de la consideration de la perspective genre dans les negociations de la Cour Criminelle Internationale. Grace au plaidoyer mene par plusieurs femmes, le Statut de Rome represente l'exemple le plus eloquent du recentrage de genre dans un traite international. Pour plusieurs, l'evidence de cette realite est desormais etablie. Elle se traduit par l'nclusion explicite du viol, d'autres crimes sexuels et de la violence du genre en tant que crimes de guerre et crimes contre l'humanite ; il y a aussi l'inclusion d'un ensemble de regles, permettant d'assurer une participation plus habilitee, ainsi que la protection adequate des victimes et des temoins ; enfin, il est convenable de mentionner des dispositions prises pour assurer la presence des femmes dans la Cour ainsi que les experts de genre parmi le personnel.

Apres le statut de Rome, les activites de plaidoyer se sont poursuivies autour des negociations des textes supplementaires des annees 1999 jusqu'en mai--2000 ou des definitions de crimes ainsi que les regles procedurales et les preuves ont fait l'objet de debats. Le caucus des femmes a participe a cette phase aussi, militant en faveur de definitions progressives et non discriminatoires du viol et d'autres crimes sexuels et relatifs a la violence fondee sur le sexe, et pronant l'adoption de regles appropriees sur les evidences produites pour des jugements de crimes lies a la violence fondee sur le sexe.

L'annee derniere, plusieurs evenements importants ont marque la fin d'une phase de creation de la premiere cour criminelle permanente mondiale et le debut d'une nouvelle et interessante ere. Avec la [60.sup.e] ratification du 11 avril 2003, le Statut de Rome est entre en vigueur le [I.sup.er] juillet 2002, marquant le moment ou la juridiction de la Cour a officiellement ete effectuee. La periode de nomination des juges a ete ouverte en septembre, puis cloturee en novembre, avec 45 candidats dont dix etaient des femmes.

Cette annee n'a pas ete sans evenements. En fevrier, l'election des dix huit (18) premiers juges a eu lieu et parmi eux il y avait sept (7) femmes. Bien qu'il soit vrai que tout au long du processus le caucus des femmes a milite en faveur de la parite, l'election de sept femmes a ete un exploit historique, a considerer le nombre traditionnellement faible de femmes servant aux tribunaux internationaux. La nomination et l'election des juges a aussi impressionnante a en juger par le travail concerte des ONG au niveau national et international dans le but d'assurer la nomination et l'election de candidates les plus qualifiees ainsi qu'une grande diversite dans la Cour. Les groupes de femmes en particulier, ont veille a ce que leurs gouvernements suivent la procedure normale de nomination des candidats. Elles ont milite en faveur de la nomination de candidates quailifiees et se sont soulevees contre leurs gouvernements quand ceux-ci ne respectaient pas les standards fixee par le Statut de Rome. Certains des groupes ont pris de grands risques pour le faire. C'etait emouvant et interessant de voir tant de personnes se retrouver encore de manieres si differentes pour produire un impact historique si remarquable.

Le 11 mars 2003, la session inaugurale de la cour s'est tenue a la HAYE, aux Pays-Bas, et a cette occasion les juges ont prete serment. L'Assemblee des Parties des Etats a choisi comme Ministere public, Luis Mereno Ocampo d'Argentine.

Maintenant que la cour est officiellement ouverte, il est temps de mettre fin au plaidoyer du caucus des femmes, qui a fait des efforts pour traiter specifiquement des negociations. Le chemin parcouru a ete long et des efforts multiples et varies auxquels plusieurs femmes du monde entier ont participe, ont ete consentis.

Les groupes de femmes du monde entier doivent desormais s'approprier la CCI et pleinement incorporer ce nouveau mecanisme de justice et de comptabilite internationales dans la conscience de notre travail et de nos strategies. Malgre le fait que le caucus des femmes, en tant qu'initiative mettant l'accent sur les negociations, a realise ses objectifs et termine son travail, des efforts visant la consideration de perspectives politiques cruciales et de genre au travail de la cour et d'aider a veiller a ce que les acquis en matiere de genre continuent d'etre mis en ouvre de plusieurs manieres doivent se poursuivre. L'une de ces voies pourrait etre au moyen d'un effort connu sous le nom Women's Initiatives for Gender Justice (Initiatives des Femmes en faveur de la Justice liee au Genre), qui disposerait d'une employee a la HAYE mais mettra l'accent sur le renforcement des capacites.

Nous fermeront bientot le bureau du Caucus des Femmes de New-York pour marquer la fin de cette initiative historique, mais retenons les adresses des unes et des autres en vue des perspectives d'avenir. Nous presentons nos felicitations et remerciements a toutes celles qui contribue de differentes manieres a cet effort, au moyen de la participation aux reunions preparatoires de la commission, au plaidoyer effectue dans les capitales, en repondant aux alertes appelant a l'action, en participant aux ateliers et formations et aux activites de sensibilisation qui s'en sont suivies, en faisant des contributions et offrant leurs services specialises dans l'elaboration des documents, des propositions et des recommandations, sans oublier l'aide inestimable du personnel, des volontaires, des stagiaires et des traductrices.

Le caucus des femmes exprime sa reconnaissance aux donateurs, aux fondations et agences gouvernementales qui en ont appuye les activites de plaidoyer dans les negociations de la CCI et encourage tout le monde a supporter les efforts des groupes de femmes afin de veiller a ce que la justice et la comptabilite reelles de genre soient mises en ouvre.
