WOMAN DIES AFTER BRUTAL BEATING.

BURBANK - A 43-year-old woman badly beaten at her Burbank home died Wednesday, and police plan to seek a first-degree murder charge against a former live-in boyfriend arrested in the attack, authorities said.

Mary Cortez died of injuries sustained in the beating, which occurred about 3:45 a.m. Sunday in the 400 block of East Harvard Road, said Lt. Kevin Kraft of the Burbank Police Department The Burbank Police Department is the police department serving Burbank, California.

Police will ask the District Attorney's Office to amend the attempted murder charge against Banos to a first degree murder charge, Kraft said.

Banos, who had worked as a mechanic, was convicted last year of beating Cortez and sentenced to one year in jail, minus 69 days for time served and good behavior Orderly and lawful action; conduct that is deemed proper for a peaceful and law-abiding individual.

The definition of good behavior depends upon how the phrase is used.
