WATER CASE GOING TO TRIAL.

Three former water company officials face trial on accusations they used the Agua Dulce Agua Dulce is Spanish for "sweet water". It also refers to various locations:

A Lancaster Superior Court judge ruled late Friday that evidence against the three is sufficient to warrant a trial and ordered them to return to court for arraignment A criminal proceeding at which the defendant is officially called before a court of competent jurisdiction, informed of the offense charged in the complaint, information, indictment, or other charging document, and asked to enter a plea of guilty, not guilty, or as otherwise permitted  June 27. The three have pleaded not guilty, and are due to stand trial in late summer, Fleck said.

Fernandez, Moison and Tomlinson are accused of using the water company's money to form their own firm, which was then hired by the mutual water company to deliver water to the Sierra Colony Estates when the local well ran dry.

The trio is charged with voting as board members to use money from the mutual company to buy trucks for their private business, American Water Supply. Investigators also uncovered illegal payments, including those to cover homeowner insurance premiums for Fernandez and Moison; as well as payments of $35,000 to Fernandez, $20,000 to Moison and $10,000 to Tomlinson, according to according to

When residents demanded access to financial records, they were refused. The board majority also approved paying $22,434 to have a well dug on Fernandez's property, according to the court complaint.

The three, recalled in April 2004, were board members for the company serving a 60-home community adjacent to the Agua Dulce Vineyards on Sierra Highway Sierra Highway is a road in Southern California, United States. It runs from Tunnel Station near the north limit of the City of Los Angeles, where it intersects with San Fernando Road and Foothill Boulevard, as well as Interstate 5, and continues north to Mojave, mostly paralleling . The incidents were recorded in 2003 and 2004.

The mutual company was formed by developers of Sierra Colony to manage the water system and the homeowners are shareholders who elect board members.

Attorney Ed Orchon has said his clients were trying to secure more water for the upscale subdivision. They were arrested in March.
