Ripley, which has trademark rights to the "Believe it or Not" slogan, claimed Vivid had illegally used the slogan and sought to stop the use of it by Vivid along with unspecified damages. Vivid President Steven Hirsch said the company agreed to settle the case out of court due to the potential high cost of defending it. As part of the settlement, Vivid will stop manufacturing, distributing or selling the two tapes. Both were released in 2001.
