It requires a DSL modem, which splits transmissions into two frequency bands: the lower frequencies for voice (ordinary operator) before the European Commission European Commission, branch of the governing body of the European Union (EU) invested with executive and some legislative powers. Located in Brussels, Belgium, it was founded in 1967 when the three treaty organizations comprising what was then the European Community on August 25. This complaint was filed on the grounds of Belgacom's abuse of its dominant position consisting of blunt and persistent refusals to grant access to its local loop. Versatel and VersaPoint are currently deploying DSL services in the Netherlands and Germany and are obliged to wait for the unbundling A regulatory requirement that enables a competing service provider to purchase parts of the incumbent local exchange carrier's network in order to provide service to its customers. See ILEC. of the local loop before offering these services in Belgium. Since March 1, 2000, Versatel and VersaPoint have repeatedly requested, and have been refused, access to Belgacom's local loop. The last refusal dates August 4, 2000 in a letter from Belgacom. Belgacom has yet to reply to Versatel's and VersaPoint's last request in a letter dated August 11, 2000. Each request also asked to obtain information on Belgacom's network architecture which includes addresses of all local exchanges, available capacity and co-location space. By refusing to provide this information, Belgacom prevents new entrants from adequately preparing their business plans and from rolling out their networks without delay. Belgacom, as a dominant carrier in Belgium, is obliged to provide access to its local loop pursuant to the competition rules. The competition rules are applicable irrespective of irrespective of prep. Without consideration of; regardless of. irrespective of preposition despite any sector regulation. For these reasons, Versatel filed a complaint before the European Commission competition authorities on July 25, 2000. VersaPoint joined this initial complaint in an addendum filed on August 25, 2000. Philip Mathuis, Managing Director Versatel Belgium comments: "We have reasons to question the real scope of Belgacom's intentions which were voiced after our complaint before the EU Commission based on four reasons: First, Belgacom did not add anything new compared to earlier statements of the regulator and the Minister of Telecommunications. Second, Belgacom's statements lack any indication as to the primary content of the announced offer. As a result, we have no indication that the type of access we legitimately requested will be awarded to us. Third, Belgacom alleges that it wants to be constructive and proactive whereas it simultaneously refuses to provide us with the necessary information on its network architecture. This information is needed to allow new entrants to effectively implement unbundling of the local loop without delay once a bilateral agreement is signed.
