Verdict Against NSPI Upheld.

The Washington (state) Court of Appeals has affirmed a lower court's $6.6 million verdict against the National Spa & Pool Institute, Alexandria, Virginia, The Court of Appeals rejected NSPI's claims that the trial court's decision wrongfully assigned liability for negligent standard setting. ASAE was among the organizations that filed amicus briefs arguing that the court not issue a decision that would limit association standard-setting activities. The court responded to briefs from ASAE and the National Electrical Manufacturers Association, Rosslyn, Virginia, stating:

"The Electrical Manufacturers and the Association Executives express concern that the imposition of tort liability would chill important trade association research and development activities, 'thereby having the net effect of decreasing product safety overall.' We recognize their concern, but we also point out that the narrow holding here need not have that effect.... The forseeability of the risk of harm distinguishes this case."
