VERDICT REACHED IN ARRA V. BARNETT PONTIAC-NISSAN

DETROIT, April 28 /PRNewswire/ -- The following was released today by the law firm of Charfoos & Christensen:
At 4 p.m. today (April 28), a two-man, six-woman Wayne County Circuit Court jury, after a one-week trial, issued a unanimous verdict for Joseph Arra with cash in the amount of $703,000 and shares equal to 25 percent of the business against Barnett Pontiac-Nissan, Inc., of Dearborn, Mich., and Robert Barnett individually.
Lawrence S. Charfoos was the attorney for the plaintiff, Joseph Arra, in this commercial contract action, where the jury found that defendants, Barnett Pontiac-Nissan and Robert Barnett individually, breached his contract with his former partner, Joseph Arra, wrongfully expelled Arra as a 25-percent co-owner of the business and caused money damages to Arra. The verdict was against Barnett Pontiac-Nissan, Inc., and Robert Barnett individually. The jury found that Arra was entitled to a return of his 25-percent interest in the business by Mr. Barnett in addition to the $703,000 from the dealership.
Charfoos & Christensen, P.C. filed its complaint against the defendants on Aug. 19, 1991. The case was mediated for $350,000 against the defendants. The plaintiff accepted and the defendants rejected. Because of this, the defendant will also be responsible for mediation sanctions as well as interest on the judgment.
Setting a new trend in commercial/contract litigation, Charfoos & Christensen, P.C. accepted the representation of Arra on a contingent fee basis. As individual and corporate plaintiffs in commercial transactions increasingly try to control litigation expenses, it is foreseeable that more and more plaintiff commercial actions will be accepted by firms such as Charfoos & Christensen, P.C., on contingent fee basis.
