U.S. SUPREME COURT AGREES TO HEAR CLAIMS BY THE LIGGETT GROUP AGAINST BROWN & WILLIAMSON TOBACCO CORPORATION

LOUISVILLE, Ky., Nov. 16 ~PRNewswire~ -- The U.S. Supreme Court today agreed to hear claims made by the Liggett Group, Inc., that Brown & Williamson Tobacco Corporation injured competition when B&W began sales of value-priced cigarettes in 1984.
Arguments before the Supreme Court are predicted to occur no earlier than spring, 1993, with a ruling following later in the year. Should the Supreme Court reject Liggett's claim, the case will be concluded.
If the claim is accepted, the suit will be remanded back to the Fourth Circuit Court of Appeals for review of two other issues not considered by the Supreme Court (antitrust injury and causation). The lower court ruled in B&W's favor on these two issues. This further review could take a year or longer following the Supreme Court ruling.
Brown & Williamson remains confident that the Supreme COurt will uphold earlier findings for Brown & Williamson by the Fourth Circuit Court of Appeals and the U.S. District Court in Greensboro, N.C.
"The lower courts have previously confirmed that Brown & Williamson did nothing more than enter, and vigorously compete, in the plain and private label cigarette category," stated Michael McGraw, Vice President -- Law and General Counsel for Brown & Williamson. "Since this case began, we have believed the courts will reaffirm our position."
Headquartered in Louisville, Brown & Williamson is a subsidiary of B.A.T. Industries, p.l.c., London. The company's U.S. cigarette brands are KOOL, RICHLAND, CAPRI, VICEROY, RALEIGH, BELAIR, BARCLAY, and GPC APPROVED. Principal International brands are CAPRI, BARCLAY, KOOL, VICEROY, KENT, LUCKY STRIKE and PALL MALL.
