U.S. Labor Dept. plans to enhance enforcement on safety violations. (Washington Alert).


In March, the U.S. Labor Dept. announced a series of policy changes regarding enforcement. Secretary of Labor Elaine Chao said that OSHA OSHA

 federal workplace and safety regulations by increasing inspections of chronic violators and pursuing court-ordered compliance.

Under the new policies, OSHA officials will be directed to conduct more follow-up follow-up,

 inspections of companies that commit safety violations of "the highest severity." High gravity citations are issued when an employer's violations are considered to be at the highest level of severity.

The Enhanced Enforcement Policy focuses on five specific areas: follow-up inspections; programmed inspections; public awareness; settlements and federal court enforcement. This initiative impacts establishments that received OSHA citations with the highest severity of willful Intentional; not accidental; voluntary; designed.

There is no precise definition of the term willful because its meaning largely depends on the context in which it appears.

Currently, follow-up inspections of OSHA regulation violators are not common. Contempt contempt, in law, interference with the functioning of a legislature or court. In its narrow and more usual sense, contempt refers to the despising of the authority, justice, or dignity of a court.  orders rarely occur and the agency doesn't regularly coordinate inspections of large corporations with multiple operations. That will change under the new policy, officials said, In addition, record-keeping changes will help OSHA track corporations that operate facilities with different names. OSHA will send a copy of citations and penalties to corporate headquarters for serious violators. The text of the new Enhanced Enforcement Plan is on the OSHA website at www.osha.gov.
