 U.S. EPA REACHES SETTLEMENT WITH PIONEER CHLOR ALKALI
 SAN FRANCISCO, April 29 /PRNewswire/ -- The U.S. Environmental Protection Agency (U.S. EPA) today announced the signing of an agreement with Pioneer Chlor Alkali Co. Inc. to settle charges stemming from a major leak of toxic chlorine gas from Pioneer's facility in Henderson, Nev.
 Pioneer Chlor Alkali has agreed to pay a civil penalty of $105,800, and fully comply with two federal statutes -- the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, also known as Superfund) and the Emergency Planning and Community Right-to-Know Act (EPCRA). The facility at 8000 Lake Mead Dr. in Henderson produces caustic acid, chlorine, and muriatic acid.
 On May 6, 1991, Pioneer accidentally released approximately 40 tons (80,000 lbs.) of chlorine gas. The U.S. EPA filed a civil complaint alleging that the facility failed to immediately notify federal, state, and local officials and submit subsequent written reports, as required under CERCLA and EPCRA.
 Chlorine is defined as an "extremely hazardous substance" under federal law. Under CERCLA and EPCRA, whenever 10 pounds or more is released, facilities must notify the National Response Center, the State Emergency Response Commission (SERC) and the Local Emergency Planning Committee (LEPC).
