U.S. District Court: GANG SECURITY PRACTICES.


Koch v. Lewis 96 F.Supp.2d 949 (D.Ariz. 2000). A prisoner brought a [sections] 1983 action against prison authorities alleging violation of the due process clause and unlawful retaliation. The district court held that a prison policy that imposed penalties based on the inmates current membership in a security threat group did not violate the ex post facto ex post facto adj. Latin for "after the fact," which refers to laws adopted after an act is committed making it illegal although it was legal when done, or increases the penalty for a crime after it is committed. Such laws are specifically prohibited by the U. S. Constitution, Article I, Section 9. clause and that the requirement that members of the group renounce their membership did not violate the free exercise clause. (Arizona Department of Corrections)
