U.S. Appeals Court: OFFICER ON PRISONER ASSAULT.


Giron v. Corrections Corp. of America, 191 F.3d 1281 (10th Cir. 1999). A female inmate INMATE. One who dwells in a part of another's house, the latter dwelling, at the same time, in the said house. R. 154; 2 Man. & Ry. 227; 9 B. & Cr.  brought a [sections] 1983 action against officers at a correctional facility alleging that she had been raped by a prison guard and that she was denied necessary medical care. The district court entered partial summary judgment for the officials and subsequently entered judgment on jury verdict for the officials on the remaining claims. The appeals court reversed and remanded in part, finding that it was plain error to instruct in·struct
